Swiss Re: The Covid Vaccines

Jane Mandigo and Chad Hindes, Swiss Re

There are a multitude of issues surround consideration of vaccine liability, including the complexity (and exposure) related to transporting the vaccine, employment liability concerns, and cyber risks. This program will fine tune your understanding of what the PREP Act covers, and what it does not. We will also explore nuances of cargo exposures and highlight some of the red flag challenges for employers, as well as why the vaccine increases cyber exposures and what types of cyber risks exist. The global vaccine effort brings with it notable liability protections, but also unique risks.


Jane Mandigo 
is a Senior Vice President with the Swiss Re P&C Business Management Claims division, holding the title of Senior Claims Expert.  In her role, she consults on issues relating to reinsurance coverage and assesses emerging risk trends for Swiss Re cedents on a variety of subject matters including: Opioids, Social Inflation, Professional Lines, Sexual Harassment and Climate Change. Before joining Swiss Re, Jane practiced with the insurance defense group at the Kansas City law firm of Shughart, Thomson & Kilroy.   Jane served a two-year term as a federal judicial clerk in the United States District Court for the Western District of Missouri, Southern Division, for the Honorable Russell G. Clark.  She is a member of the Missouri Bar and graduated from the University of Missouri, Columbia School of Law where she held positions on the Missouri Law Review and Order of the Coif.

Chad Hindes 
is a Vice President, Claims Expert within the Swiss Re P&C Business Management Claims division.  In his role, he is responsible for P&C Reinsurance Claims in the Large, Regional II segment.  Chad manages claims in multiple lines of business in P&C insurance, including Property, Workers Compensation, Professional Liability and Marine.  Chad joined Swiss Re in 2010 and has over 20 years of industry experience.  During his tenure at Swiss Re, he has served in financial analysis roles, as well as, client operational roles in P&C business management.  Chad holds a bachelor's degree in both Finance & Insurance from Missouri State University.

Kennedys: Trade Credit Insurance Exposures Arising out of the Pandemic

David Chadwick and Andrew Westlake, Kennedys

Trade credit insurance has been resilient in the face of the pandemic. We will discuss how this has been helped by limited corporate insolvencies (amendments to insolvency regulations-making it harder to wind up a company), and government-backed reinsurance to maintain confidence in the sector. Despite the resilience of the trade credit insurance market during the pandemic, global supply chains have been tested.  We will discuss how it is prudent for insurers to look again at their policies, as claims may arrive as government supports and backstops are removed. The financial crunch caused by the pandemic has uncovered potential frauds in the market and we will discuss where that has been most prevalent.


David Chadwick
is a Partner in Kennedys’ London office who qualified as a solicitor in England and Wales in 1992. His practice has a particular focus on policies involving political and financial risk, professional indemnity and insurance and reinsurance. A specialist in insurance, David has vast experience advising political risk insurers in relation to the adjustment and defence of claims involving all types of political risk policies, such as confiscation, expropriation, nationalization, and deprivation, and contract frustration and contingency (change of law) policies. He has also advised clients on credit insurance policies and has acted on a range of political violence and ‘discord risk’ claims, building up significant experience involving multi-jurisdictional claims in Africa, EMEA and Latin America. Another significant area of focus for David is the financial institutions sector, in which he has a wide range of experience acting for insurers on matters such as claims including civil liability, bankers blanket bonds and directors’ and officers’ claims. He has had heavy involvement in some of the most high-profile claims to affect the financial markets, often comprising cross-jurisdiction exposure. In addition to his contentious experience in this space, David also regularly advises on wordings-related issues and is experienced in the area of policy drafting. David handles a wide range of professional indemnity matters, acting for professionals such as investment brokers, management consultants, solicitors and surveyors. He also often acts for insurers and reinsurers in relation to claims involving litigation, pre-contractual risk assessment, policy reviews and drafting, and both treaty and facultative business. Finally, David also acts on a wide range of transactional risk claims, including claims relating to warranty and indemnity policies, and tax indemnities.


Andrew Westlake is a partner in Kennedys’ London office and is one of the leading lawyers in the political risk and credit insurance market. He advises insurers and reinsurers in London, the US, Singapore and continental Europe on the adjustment and defence of claims under all types of political risk and credit policies, including confiscation (CEND), contract frustration, unfair calling of bonds, political violence, trade disruption, structured credit and trade credit policies.  He has handled claims involving investments into or trade with emerging markets in Africa, the Middle East, Asia, Latin America and Eastern Europe. His practice includes both High Court litigation and international arbitration under the rules of the LCIA and ICC. Andrew also has extensive experience of advising insurers on recoveries following the payment of claims, including litigation, debt restructurings and insolvency proceedings. In addition, Andrew represents marine insurers in relation to large, complex claims usually involving a political element.

Executive Fireside Chat with Tracy Ryan, Liberty Mutual

Tracy Ryan is responsible for the direction, management, and performance of all commercial property, casualty, and specialty lines business in North America. She leads a team of more than 6,000 underwriters, claims specialists, and distribution professionals to deliver a comprehensive array of products, services, and solutions to our customers. Prior to this, Tracy was a chief claims officer for GRS, overseeing commercial property, casualty, and specialty claims for the Liberty Mutual, Ironshore, and Helmsman brands. Tracey joined Liberty Mutual as an actuarial analyst in 1994 and has held several key leadership positions in actuarial, product, and client management in the United States and Europe. She has also served on the boards of the National Council on Compensation Insurance and the Workers Compensation Research Institute. Tracy holds a bachelor's degree in mathematics from Fairfield University and a master's degree in mathematics from University of Colorado Boulder. She has completed the Executive Development Program at the Wharton School of Business at the University of Pennsylvania. Tracy is a fellow of the Casualty Actuarial Society.
